Green card for an asylee or refugee

Asylees and refugees may apply for a green card one year after the grant of asylum or admission as a refugee. Refugees are required to apply; asylees may. The application is Form I-485, and refugees pay nothing for it. Once approved, the residence is backdated - by one year for asylees, to the date of admission for refugees.

    An asylee's residence date is backdated one year; a refugee's is backdated to the date of admission, which shortens the wait for naturalisation.

Dónde suele fallar

  • Asylum-based adjustment times nearly doubled between FY 2025 and FY 2026, from 10.3 to 18.8 months.
  • Travel to the country you fled, even briefly, can be treated as evidence that the fear has ended and can support termination of asylee status.
  • Derivative children who age out are protected only in limited circumstances; file as early as the one-year mark allows.
  • Asylee status can be terminated after the green card is granted if the grant was fraudulent or conditions changed fundamentally.

Qué cambió en 2025 y 2026

  • Asylum-based adjustment medians rose sharply in FY 2026.
  • USCIS has increased issuance of notices to appear after denials, so a weak adjustment application now carries more risk than it used to.
