Green card for an asylee or refugee

Asylees and refugees may apply for a green card one year after the grant of asylum or admission as a refugee. Refugees are required to apply; asylees may. The application is Form I-485, and refugees pay nothing for it. Once approved, the residence is backdated - by one year for asylees, to the date of admission for refugees.

Who it is for. People granted asylum at least a year ago, refugees admitted at least a year ago, and their derivative family members.

The forms, in order

3 forms
  1. 1

Wait one year from the grant of asylum or the date of refugee admission

    Who
    The asylee or refugee
    When
1 year of physical presence after the grant or admission
    Fee
    $0

The year is physical presence in the United States, not time since filing.

  2. 2

    Get the immigration medical exam

    I-693

    Who
The applicant, through a designated civil surgeon
    When
Any time before the I-485 is decided
    Fee
Civil surgeon's own fee; $0 to USCIS

Refugees who had an overseas medical may still need vaccinations documented.

  3. 3

File Form I-485 with the medical and any needed waiver

    I-485I-693I-602

    Who
    The applicant and each derivative
    When
    After the one-year mark
    Fee
$0 for refugees and people paroled as refugees; asylees pay $1,440 paper or $1,390 online unless a fee waiver is granted

Form I-602 is the refugee and asylee inadmissibility waiver and carries no fee.

  4. 4

Attend biometrics and, if scheduled, an interview

    Who
    The applicant
    When
    Varies
    Fee
    $0

Many asylee and refugee adjustments are decided without an interview.

  5. 5

    Receive the green card, backdated

    Who
    USCIS
    When
18.8 months national median for asylum-based cases, 7.7 months for refugee-based cases in FY 2026
    Fee
    $0

An asylee's residence date is backdated one year; a refugee's is backdated to the date of admission, which shortens the wait for naturalisation.

Where it goes wrong

  • Asylum-based adjustment times nearly doubled between FY 2025 and FY 2026, from 10.3 to 18.8 months.
  • Travel to the country you fled, even briefly, can be treated as evidence that the fear has ended and can support termination of asylee status.
  • Derivative children who age out are protected only in limited circumstances; file as early as the one-year mark allows.
  • Asylee status can be terminated after the green card is granted if the grant was fraudulent or conditions changed fundamentally.

What changed in 2025 and 2026

  • Asylum-based adjustment medians rose sharply in FY 2026.
  • USCIS has increased issuance of notices to appear after denials, so a weak adjustment application now carries more risk than it used to.
