I-220A Order of Release on Recognizance

The document ICE issues when it releases someone from custody without a money bond, on conditions. It sets reporting requirements and address obligations. Whether an I-220A release counts as a 'parole' for later immigration purposes has been heavily litigated, and the answer decides Cuban Adjustment Act eligibility for many people.

  • The BIA held in Matter of Q. Li that release on an I-220A is not a parole under INA 212(d)(5), which cut off Cuban Adjustment Act eligibility for many recent arrivals; circuit courts have split on it. Keep a copy - it is often the only proof of the terms of release.
