I-881 Application for Suspension of Deportation or Special Rule Cancellation of Removal (Pursuant to Section 203 of Public Law 105-100 (NACARA))

The NACARA relief application for certain Salvadorans, Guatemalans, and nationals of the former Soviet bloc. It asks for suspension of deportation or special rule cancellation of removal under more generous pre-1996 standards. USCIS decides it for people not in proceedings; the immigration court decides it for people who are.

Fee
$340 with USCIS. Filed with the immigration court instead, EOIR charges $775 for suspension of deportation, $775 for special rule cancellation for a permanent resident, and $1,705 for special rule cancellation for a non-permanent resident. If USCIS refers the case to the court, EOIR charges no separate fee.

What changed in 2025 and 2026

  • The USCIS filing fee and the immigration court filing fee are different amounts for the same form, which trips people up. Abused spouses and children applying under NACARA pay nothing to USCIS.
