I-918B U Nonimmigrant Status Certification

The law enforcement certification that makes a U visa petition possible at all. A prosecutor, police agency, judge, or other certifying official confirms the applicant was the victim of a qualifying crime and has been, is, or is likely to be helpful. Without a signed certification dated within six months, USCIS cannot approve the petition.

  • Agencies are not obliged to sign, and some refuse as a matter of policy, which is the single biggest practical obstacle in U visa cases. Several states have laws requiring agencies to respond to certification requests within a set time.
