I-485A Supplement A to Form I-485, Adjustment of Status Under Section 245(i)

The 245(i) supplement. It lets someone who entered without inspection, or who otherwise could not adjust status, do so anyway if they were the beneficiary of a petition or labour certification filed by April 30, 2001. Everyone who qualifies pays a $1,000 penalty fee with it.

What changed in 2025 and 2026

  • 245(i) grandfathering is one of the few remaining routes to a green card for someone who entered without inspection and is married to a permanent resident. The qualifying petition must have been filed by April 30, 2001, with physical presence on December 21, 2000 for petitions filed after January 14, 1998.
