Asks the National Prevailing Wage Center to set the prevailing wage for a specific job in a specific area. It is mandatory before a PERM application and optional, though usual, before an LCA. The determination fixes the wage floor the employer must promise to pay.

What changed in 2025 and 2026
- A prevailing wage determination has a validity period; PERM recruitment and filing must happen inside it. OFLC recommends requesting an H-2B determination at least 60 days before it is needed.
