EOIR-42B Application for Cancellation of Removal and Adjustment of Status for Certain Nonpermanent Residents

The main relief for people without status in removal proceedings. It requires ten years of continuous physical presence, good moral character, no disqualifying convictions, and exceptional and extremely unusual hardship to a U.S. citizen or permanent resident spouse, parent, or child. Only 4,000 grants a year are allowed nationwide.

  • The hardship standard is deliberately severe and the 4,000 annual cap means grants are reserved decisions that can wait years. The fee more than doubled under the current schedule.
