EOIR-26 Notice of Appeal from a Decision of an Immigration Judge

Appeals an immigration judge's decision to the Board of Immigration Appeals. It must reach the BIA within 30 days of the judge's decision - a hard deadline that is not extended by mailing time. The notice must state specifically what is being appealed; a vague statement can lead to summary dismissal.

  • As of February 23, 2026 EOIR no longer accepts checks or money orders; every immigration fee must go through the EOIR Payment Portal. The 30-day deadline is jurisdictional in practice - the BIA rejects late appeals.
